5. Remember the contractual obligationsLawyers constantly remind that the oral contract (hand shake), especially at witnesses, obliges the same as also the contract made in writing. Therefore always watch the language!
Orally or in writing – never promise more than can execute. On the contrary, always carry out that promise. The legal statement that you have done the utmost for the project, will not have weight at the judge and jurymen if in the contract all was promised to execute and achieve the object. Be in advance assured that can execute all told before to express it in writing. Everything that is less than it, should be reflected in point about «performance of all possible». Very often client or its personnel can prevent your progress and success. The same concerns and the obligations connected with time frameworks. Devote to the project enough time – how much it is necessary for its end, and do not promise that execute it earlier even if the impatient client insists on it.
It is better to avoid contract specificity of you. Moreover, at any possibility it is necessary to use refutations (see the chapter devoted to contracts).
Many advisers do not know that their preliminary and definitive reports under the project can contain the things equated to amendments of the initial contract, and that such "amendments" can be used in court as proofs of infringement of the contract. Therefore be very attentive at a writing of similar reports, interoffice memorandums, etc., remaining within the limits of the contract. Would be wise to switch on in the report the offer that anything from containing in him will not change contract agreements with the client.
6. Avoid conflicts of interests
The client can submit the claim in connection with the conflict of your interests if will feel that you behave unacceptably or disloyally in connection with: ?) Your personal financial, property or commercial interests which are running counter to interests of the client; ?) Presence at you one more client, whose interests resist to its plans.
