Agreements on a delay of payments CODA (cash or def-fered arrangement), resolved now article 401 (k) the Tax code, were a component of programs of participation of workers in company profits in the early fifties. According to such agreement, the competent worker could choose, whether he wishes to receive a part of deductions of the employer from profit money or to list it in the plan of participation in profits which should correspond to certain requirements of Fiscal administration concerning time of a choice and group of competent participants. Given type CODA was not too popular in the early seventies, the quantity of such agreements did not exceed 10 thousand. In 1972 Fiscal administration has published the list corrected, the concerning taxation of the payments reducing the sizes of handed out wages and by that has created weight of questions concerning agreements. Then, on June, 27th, 1976, law ERISA has temporarily frozen the tax status of plans with elements CODA. Subsequently term has been prolonged till December, 31st, 1979. The law on incomes of 1978 has added to the Tax code article 401 (k), willows 1981 Fiscal administration has suggested to enter the rules, allowing to do in plans 401 (k) the payments reducing the sizes of handed out wages. After that employers have started to enter at themselves plans 401 (k) and to replace the payments made after payment of taxes, payments in plans of participation in the profits, made before payment of taxes.
Legislative structure ERISA
The section of I law ERISA defines rules of structurization of plans, establishes standards of behaviour of its trustees and forbids certain kinds of operations with plans. This section carries the name "Work".
